Highway Reminders from the Highway Superintendent

Residents should be aware of the following laws;

NO PARKING ON TOWN OF NICHOLS ROADS NOVEMBER 15 – APRIL 15

*Article 1219 New York State Vehicle and Traffic Law* prohibits plowing, shoveling, or blowing snow into a street or highway. This law also covers other items likely to impose a hazard to motorists, including glass, nails, wire, cans, etc.

Fines for a first offense include a fine up to $150 and or 15 days in jail, plus applicable charges.

This law also stipulates; anyone that places or permits to be placed upon any highway any material which interferes with the safe use of the highway shall immediately remove the same or cause it to be removed. This includes snow.

If you are a homeowner and hire a person to plow your driveway, and you permit them to plow the snow into the road, you could be cited under this law.

*Highway law - HAY 213 *The owners or occupants of lands shall construct and keep in repair all approaches or driveways from the Town highway, under the direction of the Highway Superintendent, and it shall be unlawful for such owner or occupant of lands to fill in any ditch or place material of any kind or character in any ditch of which in any manner, obstructs or interferes with the purposes for which it was made. The Highway Superintendent may, when directed by the Town Board, construct and keep in repair such approaches and the expense thereof shall be a Town charge.

DRIVEWAY STANDARDS

K. Drainage.

(1) A driveway must be constructed so that it does not adversely affect the highway drainage or drainage of the adjacent property. The drainage and the stability of the highway subgrade should not be impaired by driveway construction of roadside development. In no case may the construction of a driveway cause water to flow across the highway pavement or to pond on the shoulders or in the ditch.
